Does a commercial container require a building permit?
The issue of obtaining a building permit in the case of commercial containers often raises many doubts, especially due to the variety of interpretations of construction law and changing local regulations. In practice, whether a given commercial container requires a building permit depends primarily on its size, purpose, location and the time for which we plan to use it in a given place.
According to the provisions of the Polish construction law, containers with a built-up area not exceeding 35 m² do not require a building permit, but only a notification to the competent office. In such a case, the investor is obliged to inform the relevant architectural and construction administration authorities of the intention to erect the structure, indicating, m.in, the location and the time of use of the container. The notification procedure is much simpler than obtaining a full-fledged building permit, which makes smaller commercial containers an attractive solution for many entrepreneurs, allowing them to quickly start their business without complicated formalities.
However, in the case of containers with an area of more than 35 m², the situation becomes more complicated. Such facilities, in accordance with the law, are treated as standard buildings, which means that it is necessary to obtain a full-fledged building permit. This process requires a number of formalities, including the submission of a construction design prepared by an authorized architect, obtaining a decision on development conditions if the area is not covered by the local spatial development plan, and obtaining permits and arrangements from other institutions, such as the road administrator, the conservator of monuments (if the structure is located in the conservation zone) or the appropriate sanitary services. In practice, for large commercial pavilions made of sandwich panels, which exceed the limit of 35 m², the whole procedure is analogous to obtaining a building permit for standard buildings, which is associated with a greater expenditure of time, financial resources and the need for adaptation
It is also worth remembering that the time of use of the container is of great importance when classifying the facility as temporary or permanent. A temporary structure that is to be used for a period not exceeding 180 days, regardless of its size, is only subject to notification if it is removed after this period. This means that if the container is to be used as a temporary shopping kiosk on the premises of a marketplace, construction site or seasonal point of sale, no building permit will be required as long as it is removed in a timely manner. However, if the investor plans to keep the container in a given place permanently, even small facilities, less than 35 m², may require a building permit, depending on the interpretation of the local building supervision authorities. In practice, this means that before starting the implementation, it is worth consulting the office to make sure what exact regulations will apply in a given case.
